Terms of Service

1. Acceptance of Terms

By accessing or using HonestFix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to modify these terms at any time.

2. Description of Service

HonestFix is a maintenance tracking platform designed for landlords managing 1-10 rental units. The Service enables landlords to receive, track, and manage maintenance requests from tenants, coordinate with contractors, and maintain communication throughout the repair process.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized account access
  • You may not share your account with others or allow unauthorized access
  • You must be at least 18 years old to create an account

4. Subscription and Payment

4.1 Beta Access

New accounts may receive beta access before paid billing begins. During beta, plan fit and upgrade timing may be confirmed with founder support.

4.2 Billing

  • Subscriptions are billed monthly or annually based on your selection
  • Payment is due at the start of each billing cycle
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice

4.3 Cancellation

You may cancel your subscription at any time. Access continues until the end of your current billing period. After cancellation, your data will be retained for 30 days before permanent deletion.

5. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes related to property management
  • Provide accurate information about your properties, tenants, and requests
  • Respect the privacy and rights of tenants and contractors
  • Not use the Service to harass, abuse, or harm others
  • Not attempt to gain unauthorized access to the Service or other users' accounts
  • Not use automated systems to access the Service without permission
  • Comply with all applicable laws and regulations

6. SMS Terms

By opting in to SMS notifications, you agree to the following:

  • You consent to receive automated text messages related to maintenance requests
  • Message and data rates may apply based on your carrier plan
  • Message frequency varies based on request activity
  • You may opt out at any time by replying STOP to any message
  • For help, reply HELP or contact support@honestfix.io
  • Carriers are not liable for delayed or undelivered messages

7. Intellectual Property

The Service and its original content, features, and functionality are owned by HonestFix and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. User Content

You retain ownership of content you submit (photos, descriptions, documents). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

You are responsible for ensuring you have the right to submit any content and that it does not violate any laws or third-party rights.

9. Contractor Relationships

HonestFix facilitates communication between landlords and contractors but does not employ, endorse, or guarantee the work of any contractor. You are solely responsible for vetting contractors, negotiating terms, and ensuring work quality. We are not liable for any disputes, damages, or issues arising from contractor services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONESTFIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Indemnification

You agree to indemnify and hold harmless HonestFix, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Account Termination

We may terminate or suspend your account at any time for:

  • Violation of these Terms
  • Non-payment of subscription fees
  • Fraudulent or illegal activity
  • Extended inactivity

You may request account deletion at any time through your account settings. Deleted accounts are subject to a 30-day grace period before permanent data removal.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance of the new Terms.
